Drink-driving and failing to provide a specimen
In cases where the police are investigating a driver suspected of drinking and driving, the law requires the police to follow specific procedures at each stage of their inquiry, including obtaining a specimen. Failure to follow, in precise detail, the correct procedures required by law can in some cases cause a prosecution to collapse on the basis that the evidence presented to the court cannot be relied upon.
