Pre-Action Protocol Letter and issue of Proceedings_

Over the last several years pre-litigation conduct for debt recovery claims have become more comprehensive. However, there has never been a specific Pre-Action Protocol for debt recovery. Before commencing a debt recovery claim, parties should exchange requested information, act in a proportionate and responsible manner (particularly with relation to costs) and make every appropriate attempt to resolve the matter prior to starting proceedings.

We stress the importance of Pre Action Conduct to you, as the consequences of non-compliance can result in proceedings being stayed to allow the necessary steps to be taken, thus wasting valuable time and/or penalising the party at fault with cost sanctions.

Statutory Demands/Bankruptcy/Winding Up_

Whether you are concerned with your financial position or you are being threatened with bankruptcy/winding up, we can help.

As of the 1st October 2015 you cannot take any action against an individual through the insolvency process if your outstanding debt is less than £5000. However, a claim against a limited company is still £750 or above.
