If you can’t agree on a divorce financial settlement, your solicitor at Beswicks Legal can suggest a number of ways to resolve issues. Before an application to court to resolve the financial issues can be made, most people must attempt mediation (except if one of a limited number of exemptions applies). If these other methods are not for you or fail to reach a settlement, you can make a financial application to the court to resolve financial disputes arising from your divorce.

Following this application, there will be an initial administrative hearing to ensure all the information the court needs is going to be available. Following that, there will be an FDR (financial dispute resolution) hearing where each of you will make proposals and the judge will try to help you come to a settlement. Most matters can be resolved at this stage.

However, if agreement still cannot be reached, a final hearing will be held where the court will make orders about how your property, assets and income should be shared.
