What is the difference between an injunction and a restraining order? Family Law

An injunction and a restraining order both aim to protect individuals from harm, but they differ in their legal contexts.

An injunction is a civil order typically granted by a family or civil court and often used in cases of domestic violence or harassment. It can include non-molestation orders or occupation orders, controlling a person’s behaviour or access to a home.

In contrast, a restraining order is issued by a criminal court after someone has been convicted or acquitted of an offence. It prohibits the offender from contacting or approaching the victim and can be applied to both criminal and domestic violence cases.
