As well as your home, divorce financial settlements take into account income, earning capacity, savings, assets, investments and pensions.
When making decisions on divorce financial settlements the court’s aim is to achieve a ‘fair’ division of the marital assets. ‘Fair’ does not necessarily mean a 50:50 split. The court will look at things like the length of your marriage, the standard of living you enjoyed as a couple, and future economic needs and responsibilities, such as caring for children.
Many people seek a clean break order to ensure they have no financial ties to their ex following divorce. However, the court may consider spousal maintenance to be appropriate. While this is quite rare, the court can order one party to make regular payments to their ex if that spouse cannot support themselves financially following divorce.
The aim is to achieve divorce financial settlements that enable each party to move forward with their lives.
What Are My Financial Settlement Rights?
There are no specific financial rights or entitlements when you divorce. When reaching a decision on a divorce financial settlement, the court will consider your unique circumstances and decide the fairest way to share your marital assets so that you can each live independently.
You may be entitled to a share of joint assets, for example, the family home, a share of any other investments, assets or pensions, regular payments for living expenses.
For most people, child maintenance issues are dealt with by the Child Maintenance Service if the parties cannot agree a level of support, but if school fees are payable or one parent has a gross income of more than £3000 per week, the court can also deal with child maintenance issues.
To ensure the court can come to a fair decision, each party must make full and frank disclosure in relation to their financial positions. Disclosure means providing the other party with certain documentation about their financial circumstances, often using a document the courts use, called a Financial Statement or Form E.
Once a financial agreement has been reached, a consent order application must then be drawn up and approved by the court. This makes your divorce financial settlement binding (technically, once the final order for divorce is made) and provides both parties with certainty and security as to future financial positions and an enforceable order
